Americans for Public Trust (APT)

Background

Americans for Public Trust (APT) is a Virginia-based 501(c)(3) non-profit founded in 2020,¹ and describes itself as a watchdog group. The organization is closely tied to conservative activist Leonard Leo, who once served as President Donald Trump’s judicial nominee advisor.² APT frequently partners³ with the Leo-backed Honest Elections Project and its funding,⁴ and leadership is also closely linked to Leo’s network.⁵

Since its founding, APT has heavily targeted prominent Democratic donors and politicians. The group has a history of filing ethics complaints, many of which have been dismissed,⁶ targeting progressive and Democratic funders and politicians. No public actions have been taken following many of these complaints.⁷

APT’s leadership comprises numerous GOP operatives who have held leadership roles with Republican-aligned campaigns and committees. APT’s Executive Director, Caitlin Sutherland, previously served as the Research Director for the National Republican Congressional Committee and as the Deputy Research Director of the Senate Leadership Fund. She also worked for Karl Rove’s super PAC American Crossroads. Adam Laxalt, the former Republican Nevada Attorney General and Senate candidate, served as APT’s outside counsel.⁸

APT’s leadership also has ties to President Donald Trump and his administration. Laxalt previously served as co-chair of the Trump campaign. Annie Talley, who served as the APT’s president and secretary, previously worked in the Trump White House as an aide.⁹

APT has faced complaints from watchdog groups who have challenged APT’s claims of nonpartisanship.¹⁰ ¹¹ APT has dismissed the criticisms, stating the group does not “engage in anything with a partisan or political bent.”¹²

Ties to Leonard Leo

APT has numerous connections to Leonard Leo, the Federalist Society’s former Executive Vice President and co-chair.¹³ Known as the Trump “court whisperer” during the president’s first term in office, Leo has been credited with orchestrating the conservative majority of the Supreme Court.¹⁴

APT’s funding has been linked to a $1.6 billion gift¹⁵ Leo received from Chicago businessman Barre Seid to boost conservative causes.¹⁶True North Research reported that the same year the Marble Freedom Trust was created, the entity set up to receive the $1.6 billion donation, the Leo-tied 85 Fund (formerly known as the Judicial Education Project) directed $750,000 to the Legacy Foundation, which then routed $589,000 to APT. “Seed money from Leo’s The 85 Fund, via Legacy, to APT constituted nearly half of APT’s launch cash,” True North Research reported.¹⁷

The bulk of APT’s other funding is also linked to Leo. DonorsTrust, the conservative donor-advised fund known as the conservative “dark-money ATM,”¹⁸ directed more than $7.2 million to APT since 2020. DonorsTrust has routed millions of dollars to Leo-tied groups, including the Federalist Society, the Leo-led Teneo Network, the 85 Fund, the Foundation for Government Accountability, and Consumers’ Research.¹⁹

APT operatives are closely aligned with Leo and his network. From 2021 to 2023, LeElle Slifer served on both APT’s board and the Leo-chaired²⁰ Teneo Network.²¹ Former Nevada Attorney General Adam Laxalt, who later became the Trump campaign’s co-chair,²² served as APT’s outside counsel.²³ Laxalt has been described as an “ally of Leo’s.”²⁴

APT has worked closely with the Honest Elections Project (HEP),²⁵ a fictitious name for the 85 Fund,²⁶an organization Leo uses to push dark money to conservative causes.²⁷ APT and HEP frequently partner²⁸ to defend and push legislation related to barring foreign contributions.²⁹ In 2024, APT and HEP sponsored a six-figure advertisement campaign supporting a ballot initiative in Ohio that would have created a new commission on redistricting.³⁰ Voters rejected the initiative in November 2024.³¹

Payments made by APT also suggest close ties to Leo. Since 2020, APT has directed more than $1.6 million to CRC Advisors / Creative Response Concepts, the consulting firm Leo launched in 2020,³² and where he serves as chairman.³³

Previous reporting has noted that recipients of funding from Leo’s nonprofit network have paid CRC Advisors tens of millions of dollars.³⁴ This pattern became the subject of a complaint, filed by the Campaign for Accountability, which alleged the conservative activist personally benefited from nonprofit funds routed to the private consulting firm CRC Advisors and another for-profit entity called the BH Group.³⁵ Following the complaint, Politico reported that Washington D.C. Attorney General Brian Schwalb launched an investigation into Leo and his network of nonprofit groups for “potentially misusing nonprofit tax laws for personal enrichment.” The article noted that Leo was “not cooperating” with the investigation.³⁶

Since 2020, APT has directed more than $1.2 million to Holtzman Vogel Baran Torchinsky. This Republican political law firm has registered³⁷ numerous Leo entities³⁸ and earned a reputation for “creative legal maneuvers that allow donors to conservative causes to remain anonymous.”³⁹

Subject of Complaints

The group has been the subject of numerous complaints. In 2022, End Citizens United alleged the group violated its tax status for engaging in political activity.⁴⁰

Later that year, in June 2022, APT was the subject of a complaint filed by Campaign for Accountability, which alleged the group may have “illegally solicited millions of dollars in contributions since it began operations in 2020.” “The watchdog complaint alleges the total amount of money that flowed from Leo-aligned nonprofits to his for-profit firms was $73 million over six years beginning in 2016,” Politico reported.⁴¹

Ties to the Trump Administration

The organization has ties to former President Donald Trump’s campaign and administration. Trump’s Nevada campaign co-chair, Adam Laxalt⁴² served as outside counsel at APT.⁴³

Annie Talley, who serves as the group’s president and secretary, previously worked in the Trump White House. According to her biography, Talley served between 2017 and 2018 in the Trump Administration as Deputy Assistant to the President, Deputy Counsel to the President, and as chief of staff to White House counsel Donald McGahn. “At the White House, [Annie Donaldson Talley] played a significant role in helping push forward Trump’s judicial nominations; a record 30 were seated on federal appellate courts in his first two years, double the number of any previous administration.”⁴⁴ ⁴⁵

Notes that Talley wrote during her roles at the White House later emerged in special counsel Robert S. Mueller III’s report as “one of the most important narrators of internal White House turmoil.”⁴⁶

Stance on Climate Change

October 15, 2025

Americans for Public Trust (APT) issued a press release “calling on all U.S.-based organizations to return funding that they received from British billionaire Christopher Hohn,” the founder and board chair of the Children’s Investment Fund Foundation (CIFF). APT Executive Director Caitlin Sutherland stated that “For far too long Christopher Hohn, and other foreign billionaires like Hansjörg Wyss, have been able to exploit loopholes that allow foreign money to fund policy fights that shape American politics to fit their radical agendas.” Sutherland advocated that “Congress must immediately take action to end the political foreign funding of U.S. nonprofits.”⁴⁷

September 24, 2025

Americans for Public Trust (APT) released a report, “The Foreigner Radicalizing U.S. Policy: How British Billionaire Christopher Hohn Uses Foreign Dark Money to Bankroll Radical Climate Policy and Liberal Advocacy Campaigns in America.”⁴⁸

The report provided no evidence of any violations of U.S. law or IRS rules for charitable organizations. However, it called for “investigations” and “reforms” to “prevent undue foreign influence in U.S. policy fights, as foreign money coming into the United States can undermine our sovereignty and weaken our energy independence.”⁴⁹Archive URL: http://archive.today/Nlae7. ⁵⁰

The report described groups like the Center for Climate Integrity as part of a “radical climate change agenda” for supporting global climate litigation efforts to hold energy and oil industry companies accountable for their role in climate change.⁵¹Archive URL: http://archive.today/Nlae7.⁵²

October 31, 2025

Americans for Public Trust Executive Director Caitlin Sutherland is quoted in an article on Fox News Digital, stating:⁵⁵

“A lot of these groups want to ban gas stoves, very, very extremist positions. And it seems to me that when you take a look at the money, they just want to have a more extreme United States that is radicalized and further left than what we want.”

December 10, 2024

In December 2024, APT re-published the article “Ex-CCP Officials Wired Millions to US Universities and Climate Nonprofits to Promote Green Energy Initiatives” on their website.⁵⁶

The Washington Free Beacon originally published the article, which quoted American Energy Institute’s CEO Jason Isaac, who criticized Environmental, Social, and Governance (ESG) measures and environmental groups:⁵⁷

“Just as Wall Street’s ESG agenda subverts free markets to the benefit of China, EFC funds advocacy groups like the NRDC and Rocky Mountain Institute to promote policies that weaken U.S. energy independence,” Isaac told the Free Beacon.⁵⁸

APT executive director Caitlin Sutherland also provided comments to the Free Beacon:⁵⁹

“The Energy Foundation’s direct ties to the CCP are incredibly alarming, as they’ve spent millions to push for radical climate initiatives that favor China and harm American energy production,” Sutherland said.⁶⁰

“Their dark money has been funneled to groups that want to ban gas stoves and phase out fossil fuels,” she continued. “Next year, Congress should continue their investigation to determine the extent to which China is undermining American energy dominance through this group.”⁶¹

Actions

October 31, 2025

APT released a report, “Foreign Charities Fueling Extreme Policies in the U.S.,” alleging that several Europe-based philanthropic foundations had “spent almost $2 billion bankrolling U.S. policy fights and advancing an extreme climate agenda.” Although the report provides no evidence of any violations of U.S. laws or IRS rules governing charities, APT calls for: “State and federal authorities should begin investigations to determine the extent of foreign ‘political’ giving in the U.S., whether existing laws have been broken by these foreign actors, and if further legislation is necessary to curb foreign interests and influence.”⁷²

Fox News Digital broke the news of the APT report, quoting Americans for Public Trust executive director Caitlin Sutherland stating: “It seems clear to me that this foreign money is coming into the United States because they want to implement their extremist European vision for America… A lot of these groups want to ban gas stoves, very, very extremist positions. And it seems to me that when you take a look at the money, they just want to have a more extreme United States that is radicalized and further left than what we want.”⁷³

October 15, 2025

February 2025

Caitlin Sutherland, representing Americans for Public Trust, testified in support of House Bill 793 in the Missouri House of Representatives. Sutherland summarized the bill “to ban foreign nationals from contributing to ballot measure campaigns.”⁷⁷

“This legislation is crucial to enact, especially since Missouri has seen $13 million in foreign-tied spending influencing your state ballot measures, and I applaud Representative Baker for taking action,” Sutherland claimed.⁷⁸

“While Missouri and federal law already prohibit foreign nationals from influencing elections, the laws are not nearly strong enough,” she added.⁷⁹

Adam Laxalt appeared on a Tucker Carlson Fox News segment⁸⁰ and pushed the false narrative that mail-in voting led to voter fraud in Nevada.⁸¹

“This is the game,” said Laxalt, outside counsel for the nonprofit Americans for Public Trust. “It’s about winning elections and gaining power and here in my swing state … you are seeing videos of thousands of ballots that are piled up in apartments and trash cans and in hallways.
