On July 6, 2026, E&E News reported that Levy would join the DOJโs Energy and Natural Resources Division as a senior counsel with a start date of July 13, 2026. He earned his J.D. with honors from the University of Texas School of Law in 1986 and, early in his career, served as a briefing attorney for Judge Robert Parker of the U.S. District Court for the Eastern District of Texas. He is a longtime member of the Texas Supreme Court Advisory Committee and sits on advisory councils of the Atlantic Legal Foundation, the Center for Law & Public Policy, and the Mountain States Legal Foundation. Role in the โTort Reformโ Campaign Against Climate Liability Lawsuits
Levy has held leadership positions in a network of overlapping tort reform organizations that have promoted narrowing โpublic nuisanceโ liability, the legal theory underpinning many of the climate damages lawsuits filed against ExxonMobil and other oil majors.ย Several of them have supported state โclimate liability shieldโ legislation that would defeat such lawsuits through statute. These groups include the American Tort Reform Association (ATRA), the American Tort Reform Foundation (ATRF), the Civil Justice Reform Group (CJRG), Lawyers for Civil Justice (LCJ), the U.S. Chamber of Commerceโs Institute for Legal Reform (ILR), the Federalist Society, and the Texas Civil Justice League (TCJL).11โRobert L. In March 2020, ATRA published a report on โpublic nuisanceโ lawsuits โ lawsuits in which state officials sue private companies for the negative impact of their activities on public welfare. The report covered climate, opioid, and vaping litigation, and recommended limiting public nuisance torts to a narrower โhistoricalโ common law definition โ an approach that under-girds โclimate liability shieldโ bills being supported by fossil fuel companies and drafted by lawmakers across the US.23American Tort Reform Association. Levy sits on the executive committee of the Texas Civil Justice League, an ATRA state affiliate, and has been honored by TCJL and Texans for Lawsuit Reform for his years of service to Texas civil justice reform.96โRobert L. During the 2025 Texas legislative session, TCJL backed public nuisance limitation legislation (SB 779 by Sen. Mayes Middleton / HB 3964 by Rep.
